The following terms and conditions apply to all transactions on www.DecoratedFurniture.com. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your agreement to these terms and conditions. Please read them carefully and print a copy for future reference.

GENERAL

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery to a US address. Each order for our furniture will be considered an agreement by you to these terms and conditions with an offer to purchase subject to them.

WARRANTY

All frames are guaranteed from defects in construction for a period of one year from the date of invoice, provided there is no evidence of abuse. There are no other warranties or guarantees expressed or implied. All fabrics, foam and Dacron are purchased from reputable mills. No mill, however, will offer a guarantee or warranty on their fabrics. Therefore we are unable to honor adjustments, claims, or credit for fabric wearing, color fastness, or shrinkage.

PAYMENT & PRICE

We accept Visa, MasterCard, American Express and PayPal. We can also take phone or fax orders.
All options except PayPal are set in Our Shop Cart to do an Authorized Only Transaction. Which means we put a hold on the money from your charge card until we are ready to ship. Unless your order is custom, No Funds are actually deducted from your account until we ship. All Custom orders will have the total price payable for the goods debited from your bank card or account at the time you place your order.
Your particular credit card may lower your credit limit for the amount of the funds on hold.
The prices shown are the already discounted prices.
We reserve the right to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. If this be the case, we will inform you of the correct price and give you the opportunity to cancel the order with no obligation on your behalf to honor the purchase.

Shipping service is provided free of charge.

SHIPPING TIME

The time needed to ship merchandise will vary depending on the shipment's location and the particular time of year. Customers should expect a 6-8 week delivery time.

When we place an order the manufacturer it takes about 3-4 weeks for construction and hand decoration and we then notify our delivery service to pick up your order. It then is checked into their delivery system. You are then called by the delivery service and arrangements are made for delivery directly with you within another 3-4 weeks.

BACKORDERS / PRODUCT DELAYS & OUT OF STOCK ITEMS

Backorders are a result of manufacturer delays in producing products to be shipped directly to DecoratedFurniture.com customers. DecoratedFurniture.com may backorder any item ordered and ship that item at a later date at no cost to the customer. It's possible that some items may be temporarily out of stock for as long as 2 to 6 weeks due to manufacturer and import delays or other unforeseen circumstances. Customers will be notified only if item ordered has been discontinued or is no longer available.

RISK

As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

DAMAGED SHIPMENTS & CLAIMS

Each piece has been carefully inspected and securely packed before it is transferred to a carrier.
We use the utmost care in shipping your furniture, but occasionally items do get damaged. We will replace, at no cost to you, the damaged item. If for any reason you notice any damage to the carton or box, if torn or tattered, you must have the delivery person write on your copy of the bill the extent of the damage and sign and date it, stating that the box or product was damaged. Less than 1% of shipments have any damage.

--THIS PROCEDURE MUST BE FOLLOWED--

If there is damage, it is best to call us immediately, but no less than 3 days after accepting delivery and we will take care of any problem. We will provide the paperwork for you and immediately order or reorder the product in this rare case. The nature of the business in certain instances may leave an item with a small scratch etc. In these cases we will make judgment to the degree and in most minor cases will provide touch up etc, as provided with a local furniture store. We ask that you perform this minor procedure. We reserve the right to make the proper judgment as to the repair.
When in doubt email us at service@DecoratedFurniture.com and we will advise you on what to do with any problems you might have.

We are not responsible for damages or loss occurring in transit. Before accepting any merchandise from carrier, INSPECT CAREFULLY, note any loss, shortage or damage (freight or concealed) on the delivery receipt and IMMEDIATELY notify the carrier and DecoratedFurniture.com of the problem.
Damaged shipments from handling must be claimed with our freight carrier. Since our freight carrier will come into your home and set up, if there is any transit damage, be sure to make a claim at that time. Also If any cartons are missing, incorrect or damaged, be sure to make a claim and note this on the freight bill. (Have the delivery person write on your copy of the bill the extent of the damage and sign and date it.) If you notice concealed damage after the driver has left, keep all the packing and call the freight carrier to return and inspect the damage and file a claim.

REPLACEMENT

All Claims for shortage or damage must be made within 7 days of receipt of goods. Once the invoice is mailed, changes or short payments are not allowed. No items can be returned without a Return Authorization (RA). Before an RA can be issued the customer must send a photograph of the defect along with the written statement clearly stating the manufacturing defect.
Replacement order requests must be faxed (520-723-2921) or mailed to our office and must contain the following information: Invoice Number, Date, Item Number & Fabric Number.

TIME LIMITATIONS FOR NOTIFICATION OF CLAIMS

Damage in transit: If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 7 days from delivery.

SHORTAGES

It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 7 days from delivery. In-Correct Goods: it is your responsibility to notify us of any in-correct goods supplied within 7 days from delivery.

SHIPPING STATUS

You may e-mail service@DecoratedFurniture.com for status inquiries. Please provide name of person who placed order, name of person item is shipping to, and brief description of items ordered. Tracking numbers may not be available for all shipments, if an order has been shipped and is past due for delivery, miss-delivered or possibly lost by the shipping company, you must contact DecoratedFurniture.com within 7 days to have the order tracked.

NON-DELIVERIES

We will not accept liability for goods lost in transit unless we are notified within 7 days from the expected delivery date.

CANCELLATION OF ORDERS

We will be happy to cancel any order after it has been placed with us, providing that production has not started at the factory for a custom order OR the warehouse has not already removed and prepared your item for shipment.

A 15% restocking fee will be charged to you to cancel once the item has been removed from stock.

Customer must advise, in written form BY FAX (520) 723-2921 OR e-mail
cancel@decoratedfurniture.com, within 48 hours of receipt of Order Acknowledgement that they want to cancel to avoid the 15% restocking fee that the warehouse charges decoratedfurniture.com to cancel with them once they have removed it from stock.

Please be sure an acknowledgement of your canceled order was received back to you from decoratedfurniture.com to ensure that your cancellation was received within the 48 hour time.

The same policy applies if any discrepancies are noted in the order and the order needs to be adjusted.

SPECIAL ORDERS

All furniture on our site is imported via Fairfax suppliers from China and once ordered we are not in a position to effect a cancellation with them.
All merchandise that is made to customer specifications are a "Special Order" and are NON-RETURNABLE. Therefore, cancellations cannot be accepted after fabric has been cut.

IF the items have been shipped, we will follow our “Return Policy” which states that you may return your purchase to us for full credit LESS the actual freight charges to you from the manufacturer and then from you to our warehouse and LESS the 25% RETURN//RESTOCKING FEE.

Settlement for the freight charges is made when we receive the actual freight bills. A copy of the freight bills will be provided upon request.

If it becomes necessary to return remember a 25% RETURN fee will be charged due to our suppliers terms.

RETURNED GOODS

We will replace, at no cost to you, the damaged item.
Once you have informed us within the 7 days of our error, be it incorrect items, damaged items, an incomplete order, or any error on our part, we will make every effort to replace your order and satisfy the original agreement first to your satisfaction.

We will accept returns on any item in resalable condition

If, for no fault on our part, you wish to return your purchase, our suppliers charge a 25% RESTOCKING FEE and it is your responsibility to return any such items in a pristine salable condition in their original box and packaging.
To make a return under this policy you must call us to return within 7 days after the date receiving your shipment. If you notify us within 7 days we will reimburse you 100% less freight charges and restocking fees. Simply call us and we will assist you with your return.

Since most items are custom made with custom made fabrics and finishes, You will be wholly responsible for the return of the goods and any associated costs of return. Goods received back incomplete, damaged or in any condition other than salable, will be returned to you and the cost of return carriage charged to your account.

We cannot give credit for products that come damaged to us. In this case we will help you get your claim from the freight company.

Prior to returning any products, please contact us within 7 days from the date of delivery.

FINISHES AND MEASUREMENTS

Since all our furniture is hand decorated a slight variation in color, finishes and measurements my occur, this is natural and insures the unique nature of our hand decorated furniture.

FABRIC SWATCHES

At this time, all that is available is the entire swatch book, which requires a fully refundable $150 deposit regardless of purchase. Plus a non-refundable $20 shipping.
We will hold $150 shipping that is fully refundable (minus the $20 shipping cost) upon return regardless of purchase. Due to the increased cost of these swatches, we will charge an additional $100 after two months as a further incentive to customers to return the fabrics. This extra fee is also refundable upon return.

All product specifications, images and other information published on our website has been made accessible by our suppliers, or has been gathered from public-domain sources. The intention of DecoratedFurniture.com is that all information on the website should be as accurate and up to date as possible. However, DecoratedFurniture.com cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.
